This document details how we, TERA-print, LLC, process and utilize the “Personal Data” (defined in Section 1) of individuals or groups (defined as “Persons” under Section 1) who contact us (via email, phone, fax, etc), use our website, or who visit us at our premises or events. In addition, this document details the privacy rights of our intellectual property (defined as "Intellectual Property Rights" under Section 1).

Please read this document carefully. Note that by visiting our website, you acknowledge (i.e., “Consent” as defined in Section 1) the information detailed within this Privacy Policy.

1.    Definitions: Capitalized terms have the meanings set out or referred to in this Section 1.

"Person" means any individual, partnership, corporation, trust, limited liability entity, unincorporated organization, association, Governmental Authority or any other entity.

“Company” is defined as TERA-print, LLC, and its representatives (i.e., employees).

“Personal Data” is all information relating to an identifiable “Person”. This information can identify, either directly or indirectly, a particular “Person”, and includes name, location, online identifier, e-mail address, physical information, psychological information, and economic information.

“Data Processing” means any process or series of processes in relation to “Personal Data”, such as collection, organization, reading, use, dissemination, or erasure.

“Consent” means any informed and unambiguous expression of will on the part of a “Person” or TERA-print, LLC for the processing and sharing of “Personal Data” concerning themselves.

"Confidential Information" has the meaning set forth in Section 3.1.

"Intellectual Property Rights" means all industrial and other intellectual property rights comprising or relating to: (a) Patents; (b) Trademarks; (c) internet domain names, whether or not Trademarks, registered by any authorized private registrar or Governmental Authority, web addresses, web pages, website and URLs; (d) works of authorship, expressions, designs and design registrations, whether or not copyrightable, including copyrights and copyrightable works, software and firmware, data, data files, and databases and other specifications and documentation; (e) Trade Secrets; and (f) all industrial and other intellectual property rights, and all rights, interests and protections that are associated with, equivalent or similar to, or required for the exercise of, any of the foregoing, however arising, in each case whether registered or unregistered and including all registrations and applications for, and renewals or extensions of, such rights or forms of protection pursuant to the Laws of any jurisdiction throughout in any part of the world.

"Company’s Intellectual Property Rights" means all Intellectual Property Rights owned by or licensed to TERA-print, LLC.

"Trade Secrets" means all inventions, discoveries, trade secrets, business and technical information and know-how, databases, data collections, patent disclosures and other confidential and proprietary information and all rights therein.

2.    Intellectual Property Rights”.

2.1 Ownership. Visitor acknowledges and agrees that, except to the extent expressly provided in Section 2.3 below:

(a) The “Company” (or its licensors) will retain all "Intellectual Property Rights" used to create, embodied in, used in and otherwise relating to the Products and any of their component parts;

(b) any and all “Company's Intellectual Property Rights" are the sole and exclusive property of the “Company” or its licensors;

(c)     Visitor shall not acquire any ownership interest in any of “Company's Intellectual Property Rights” under this Agreement;

(d)     any goodwill derived from the use by Visitor of “Company's Intellectual Property Rights” inures to the sole and exclusive benefit of the “Company”;

(e)     Visitor shall use “Company's Intellectual Property Rights” only in accordance with this Agreement and any instructions of the “Company”.

2.2     Prohibited Acts of Visitors. Visitor shall not:

(a)     take any action that interferes with any of the “Company’s” rights in or to “Company's Intellectual Property Rights”, including the “Company’s” ownership or exercise thereof;

(b)     challenge any right, title, or interest of the “Company” in or to “Company's Intellectual Property Rights”;

(c)     make any claim or take any action adverse to the “Company’s” ownership of “Company's Intellectual Property Rights”;

2.3     Prohibited Acts of Website Users. “Persons”, whether they purchase technology from TERA-print, LLC or not, who visit our webpage, whether they “Consent” to providing “Personal Data” or not, are prohibited from doing the following with respect to the TERA-print official website:

(a)     copying and displaying any content such as pictures, information, manuals, descriptions, or any other part of our website or sub-websites that fall under the purview of TERA-print, LLC “Intellectual Property Rights” onto a third party webpage, except in the case of the written “Consent” on the part of TERA-print, LLC.

(b)     copying and displaying any content such as  pictures, information, manuals, descriptions, or any other part of our website or sub-websites under the purview of TERA-print, LLC “Intellectual Property Rights” onto a third-party public or private presentation for the public or private dissemination of research or marketing, except in the case of the written “Consent” on the part of TERA-print, LLC.

(c)     using computer code, irrespective of the codes origin, personal or otherwise, to skim either our website or sub-website for information that falls either under the purview of TERA-print, LLC “Intellectual Property Rights”, or for “Persons” “Personal Data”

(d)     using personal computer code to insert malware into our website or sub-websites to steal the “Personal Data” of “Persons” that has been shared with TERA-print, LLC with the “Persons” “Consent”.

3.    General and “Personal Data”.

3.1.     Scope of General Data Collection. Our website collects general data and information each time a “Person” visits our website. This information includes the following, and cannot be used to concretely identify a “Person”:

(a)   Website Traffic:

a.     Device Type, which is defined as the type of device (e.g., Desktop, Mobile, etc.) used to visit our website

b.     Web Source, which is defined as the route utilized by a “Person” to visit our website (e.g., Google, Bing, Direct URL, etc.) 

c.     Browser Type, which is defined as the browser used to visit our website (e.g., Chrome, Safari, etc.)

d.     Operating System, which is defined as the Operating System utilized to visit our website (e.g., Windows, Mac, etc.)

e.     Geography, defined as the visiting Country of Origin identified by the visiting IP address (e.g., USA, Germany, China, etc.)

f.     Search Keywords, which is defined as the word or phrase used within search engines to locate and visit our website or sub-websites

g.     Traffic Sources, which denote whether or not a “Person” visited our website through a web browser search engine or through our social media sites (see Section 4.3)

3.2     Scope of “Personal Data” Collection.  Our website collects “Personal Data” and information when a “Person” submits their information for access to our newsletter or to contact TERA-print, LLC for further information about our products. By submitting either form, a “Person” has given “Consent” for their information to be saved and utilized by TERA-print, LLC. This information includes the following:

(a)   E-mail Address

(b)  Name, where the first name is required, and the last name is optional

(c)   A short personal message detailing the nature of the inquiry

In addition, TERA-print, LLC may also collect further personal information that is provided willingly by a “Person” over the course of correspondence. This information includes, but is not limited to, the following:

(a)   Billing Address

(b)  Shipping Address

(c)   Phone Numbers

(d)  Position and Place of Employment

(e)   Payment Information

(f)   Content and E-mail Correspondence

3.3)     Social Media. TERA-print, LLC collects information regarding whether or not a “Person” visited our website by first visiting our social media sites. This information only designates the amount of web traffic that originates from our social media accounts and cannot be used to identify any particular “Person”. Please see the following privacy policies of the social media websites that are currently used by TERA-print, LLC for more information (future updates regarding the use of social media [i.e., the deletion or creation of new accounts on a particular social media platform] will be updated on this Privacy Policy):

3.4)     Protection of “Personal Data” and “Data Processing”. TERA-print, LLC is dedicated to ensuring that the “Personal Data” listed above will not be shared with any third-party, except in the explicit case that the “Person” gives explicit “Consent” to do so. Otherwise, TERA-print, LLC may use the information given by a “Person” to perform the following “Data Processing” tasks in the interests of our business and our customers:

(a)   Responding to inquiries, and other communications

(b)  Providing services through our website, and the sale of products and services

(c)   Sending personalized marketing communications as permitted by law or as requested

(d)  Publishing links to scientific articles wherein TERA-print, LLC devices were used to perform experiments

(e)   Ensuring security and protecting against fraud

(f)   Developing and improving our services
